These Terms of Use ("Terms") govern your access to and use of the Craft Navigatormobile application and related indoor and on-site augmented-reality navigation experience (the "Service"). The Service is provided by ARport Navigation Kft.("ARport", "we", "us", "our"), Hungary.
By installing, opening, or using the Service, you agree to these Terms. If you disagree, uninstall the Service and discontinue use.
How we handle personal information is explained in our Privacy Policy.
1. Who may use the Service
The Service is intended for visitors at a participating site, using their own compatible mobile device or a device operated under venue rules.
You agree to comply with lawful venue rules while using the Service.
If an organisation distributes or configures the Service (venues, kiosk devices, bundled handsets), its policies and contracts with ARport or its partners add to these Terms where they apply to you—but nothing here replaces non-waivable rights for qualifying consumers under mandatory law.
2. Access (licence key)
Deployments may authenticate using a licence key (or equivalent programmatic access) rather than a personal visitor login. Scope, geography, permitted devices, uptime expectations, revocation, migration, rotation, analytics scope, billboard programme, SLAs—are primarily defined in commercial agreements between ARport and the site operator/partner.
You agree not to:
- misuse, share, disclose, publish, brute-force guess, spoof, circumvent, resale, scrape, scrape assets at scale violating agreements, degrade security measures without authorisation—or otherwise abuse materials that grant authorised access including tokens/session artefacts;
unless law non-waiverably empowers you independently.
We may suspend, modify, degrade compatibility, discontinue features/backends for security/abuse/policy compliance/contract/client requirements/law—even if inconvenient.
3. Limited licence grant
Subject to lawful deployment and these Terms (and overriding mandatory rights), ARport grants you a personal, limited, revocable, non-exclusive, non-transferable licence to run the distributed Craft Navigator client solely for authorised on-site navigation and related features as configured—including optional telemetry/analytics features, feedback, promotions on virtual billboards, and offline cache/sync consistent with our Privacy Policy.
Beyond that licence, ARport reserves all rights not expressly granted.
4. Acceptable use
You agree not to use the Service to:
- break applicable law or infringe others' rights, including harassment or unlawful discrimination, distribution of malware, or unlawful interception or recording of communications;
- bypass security controls, circumvent access restrictions, misuse credentials or tokens, or reverse engineer/decompile/disassemble except where statute requires that capability and cannot contractually be excluded;
- attack or overload the Service or backends (including denial‑of‑service attacks, unauthorised security testing against production systems without written mandate, unauthorised bulk scraping abusive rate patterns);
- remove or obscure proprietary notices, misappropriate datasets or creative assets supplied for navigation, misuse trademarks, or commercially exploit authored content beyond what lawful deployment expressly allows;
- use Service outputs where they would be unsafe or unlawful without separate authorisation—for example specialised safety‑critical aviation/maritime/rail control, unauthorised access to hazardous or restricted premises, regulated medical overlays, defence/classified/industrial‑control regimes—beyond normal visitor orientation at a staffed commercial/campus‑style premises.
Separate venue/operator schedules under commercial agreements may add industry-specific obligations and enforcement.
5. Navigation & AR reliability; your safety (read carefully)
Real-world navigation depends on GNSS reception, sensors, physics, crowds, evolving building layouts, Vuforia/AR platform stacks, caching, downloads, latency, emergencies, staffing decisions, hoardings, elevators, slippery surfaces—the stack is inherently imperfect.
The Service produces guidance; it does not guarantee perfect alignment with physical reality.
You remain fully responsible for your own safety and the safety of people you supervise, for your valuables, for mobility aids, for organisation-specific occupational rules (if applicable), and for obeying lawful site orders.
- obey site operator emergency/security/evac/medical/industrial supervision instructions—even if AR disagrees—
- minimise distraction walking especially stairs ramps wet floors crowded spaces vehicle interfaces—
- verify physical obstacles doorway widths guardrails yourself—
- avoid restricted spaces without authorisation—
Do not treat AR overlays as proof that a door route ramp lift state is safe authorised current uncongested legally compliant for your situation.
Emergency number in Hungary: 112.
Nothing in this section limits liability where Hungarian law forbids such limitation.
6. Billboard & promotional content
Versions may show commercial sponsorship informational or brand content on virtual billboards or similar surfaces anchored to authored geometry/UI.
You acknowledge:
- creatives may change over time including remotely configured rotations schedules campaigns—
- ads may influence purchasing health lifestyle choices—legal compliance for regulated claims (allergen alcohol health claims minors protection etc.) remains primarily with advertisers agencies venue contracts—not fully dumped onto ARport via generic disclaimer alone although ARport escalates abuse reports contractually feasible—
- architecture described without third-party behavioural ad SDKs GAID/IDFA audience building in baseline Privacy Policy appendix—yet contextual deployment-owned signals may still determine which campaign variant appears subject privacy programme evolution DPIA counsel—
Report misleading or harmful creatives to venue staff and info@arportnavigation.com; remediation timelines depend on contracts and facts.
7. Analytics telemetry feedback
Categories purposes retention legal bases cross-border processors rights channels—Privacy Policy controls detail.
Submitting feedback text typically grants ARport (and designated processors/partners for quality analysis) a licence to use that content under applicable law including aggregation anonymisation analytics bug triage escalation—subject statutory withdrawal/forgotten interplay counsel defines UI alignment.
Maintain parity Privacy Policy indefinite journey retention indefinite feedback retention backups windows Supabase ops logs billboard evolution analytics expansion tracker introduction—revision discipline.
8. Intellectual property
Except for third-party/Open-Source components under their licences (referenced in-product where required), ARport and its licensors retain rights in the Craft Navigator software integrations proprietary formats tooling schemas pipeline glue etc.
Venue-provided CAD-derived geometry trademarks billboard creatives OSS meshes remain their owners' IP—you receive no broader licence than needed to consume them inside authorised navigation UX absent separate written clearance.
Honor OSS attribution compliance notices bundled.
9. Third-party technology & storefronts
Third parties include—not exhaustive—Vuforia/PTC Unity Supabase (EU-hosted per programme) Android Google Play services location fused stacks iOS CoreLocation Google Play Apple App Store payment dispute channels etc.
Their supplemental terms/API policies apply as usual for mobile ecosystems.
Connectivity/mobile data/roaming charges are yours.
10. Updates maintenance compatibility
Stores/OS evolve—older devices/OS may lose support without long advance notice practicality.
Breaking backend migrations cryptography rotations sanctioned jurisdiction blocks security incidents lawful orders may disrupt sessions purge caches—
You accept reinstall friction where Privacy Policy admits residual backup windows—
11. Disclaimer of warranties
To the fullest extent permitted by Hungarian law—and without removing non-waivable statutory conformity/warranty regimes for qualifying consumers/software supply relationships where mandated—the Service is provided AS IS and AS AVAILABLE.
We disclaim extra implied warranties of merchantability fitness for particular purpose quiet enjoyment uninterrupted error-free malware-free completeness timeliness suitability for specialised regulated industries—
Counsel verifies interplay paid vs free visitor client-funded transactional facts affect mandatory warranties.
12. Limitation of liability
To the fullest extent permitted by Hungarian law:
- Neither ARport nor its officers directors employees contractors affiliates licensors subprocessors—as applicable—is liable for indirect incidental consequential special exemplary punitive moral pure economic ripple reputational expectation damages data loss intangible loss arising from Terms/Service—unless statutes impose non-waivable liability—for example intentional wrongdoing gross negligence categories personal injury product liability regimes—
- Any aggregate contractual monetary cap (if lawful for category of claimant—consumers/B2B differ) shall be drafted by counsel—we omit speculative numeric placeholders here—
- Separate venue/advertiser agreements may indemnify IP/advert fallout—consumers ordinarily outside those chains unless subpoena—
Broad consumer indemnities may be ineffective under HU law verify drafting.
Revise expressly with Hungarian counsel aligning caps exclusions insurance interplay.
13. Termination; survival
Access ends upon licence revocation contract termination platform removal abuse security incident sanctioned jurisdiction block uninstall etc.
Sections that by nature ought continue—IP permitted disclaimers permissible liability exclusions indemnities lawful governing law permissible assignments surviving fees accrued pre-termination lawful feedback licence narrowing post-withdrawal etc.—remain effective where law allows—

14. Governing law & disputes (draft positioning)
Hungarian substantive law governs—with respect for overriding mandatory protections of habitual EU residences if qualifying consumer transactional facts—
Competent Hungarian courts generally—preferably specified city Budapest vs general competence—needs counsel precision—B2B may choose arbitration venue language package separately—

For consumer-facing HU deployments, publish a Hungarian authoritative version of these Terms alongside English (if used) to reduce interpretation disputes.
15. Changes to these Terms
We may update these Terms materially (for example features, analytics, advertising, subprocessors, corporate events). We typically do so by linking the updated Terms from the app store listing and/or an in-app or website link, and by informing deployment partners where contracts require it. Stronger notice or explicit consent may apply where mandatory law requires it.
Continued use after the effective date of an update may constitute acceptance; you may always stop using the Service by uninstalling.
Material tracking expansion requires Privacy Policy coherence update synchronously.
16. Severability assignment notices
Invalid or unenforceable provisions are limited to the minimum extent needed; the rest of the Terms remain in effect. ARport may assign these Terms in connection with a merger, acquisition, or reorganisation, without abusively reducing mandatory consumer protections.
